Privacy Policy for Oakbridge Law and Mediation

Effective Date:  November 20, 2025

Oakbridge Law and Mediation is committed to protecting the privacy and confidentiality of personal information entrusted to us. As lawyers governed by the Law Society of Saskatchewan, we adhere to the highest standards of confidentiality under Chapter 3.3 of the Law Society of Saskatchewan's Code of Professional Conduct, which requires us to hold in strict confidence all information concerning the business and affairs of our clients acquired in the course of the professional relationship. This duty often exceeds the requirements of applicable privacy legislation.

In addition, our collection, use, and disclosure of personal information in the course of providing legal services is governed by Canada's Personal Information Protection and Electronic Documents Act (PIPEDA), as well as other applicable federal and provincial laws.

1. Personal Information

Personal information is any information about an identifiable individual, including but not limited to name, contact details, financial information, family details, or other data relevant to your legal matter.

2. Collection of Personal Information

We collect personal information only when necessary to:

  • Establish and manage lawyer-client relationships
  • Provide legal advice, representation, or mediation services
  • Conduct conflict checks
  • Comply with Law Society requirements or court rules
  • Process payments or manage billing
  • Communicate with you about your matter or firm updates (with your consent where required)

We collect this information directly from you, or from third parties where you have consented or as authorized by law.

3. Use and Disclosure of Personal Information

We use and disclose your personal information only for the purposes for which it was collected, or as otherwise permitted or required by law. Examples include:

  • Sharing with other parties in your legal matter (e.g., opposing counsel, courts, mediators) with your instructions or consent
  • Retaining experts, agents, or other professionals on your behalf
  • Complying with legal or regulatory obligations

Important Note on Confidentiality and Solicitor-Client Privilege: Information shared with us in the course of seeking or receiving legal services is protected by solicitor-client privilege and our professional duty of confidentiality. We will not disclose privileged or confidential information without your express authorization, except in rare circumstances permitted by law (e.g., to prevent serious harm) or as required by a court order.

4. Unsolicited Communications and Website Contact

Submitting information through our website (e.g., via contact forms or email) or sending unsolicited emails does not create a lawyer-client relationship, nor does it establish solicitor-client privilege or confidentiality. Such communications may not be secure or protected. We recommend avoiding sending sensitive or confidential details until a formal retainer is in place. Emails and online submissions are not automatically confidential and may be disclosed if required by law.

5. Security and Safeguards

We employ reasonable physical, administrative, and technical safeguards to protect your personal information from unauthorized access, use, or disclosure. This includes secure storage, encrypted communications where possible, and limited access on a need-to-know basis.

6. Retention and Destruction

We retain personal information only as long as necessary for the purposes identified, or as required by law (including Law Society record-keeping rules). When no longer needed, we securely destroy or anonymize it.

7. Access and Correction

You have the right to access your personal information in our custody or control and to request corrections if it is inaccurate. Contact your lawyer directly for such requests. Access may be limited where it would reveal privileged or confidential information about another person.

8. Website-Specific Practices

Our website may use cookies or analytics tools for functionality and to improve user experience. We do not collect personal information through these tools without consent. Links to third-party sites are not governed by this policy.

We review and update this policy periodically. When amendments are made this policy will be updated accordingly and the currently version of this policy will always be posted on our website.

This policy aligns with our obligations under PIPEDA and the Law Society of Saskatchewan's Code of Professional Conduct, ensuring your trust in our handling of sensitive information. We look forward to serving you with integrity and discretion.
